What consent must parents give for their child to use Dojo Tutoring?

Parent permission is an integral part of using Dojo Tutoring. When you visit Dojo Tutoring and give parental consent, you are granting permission for the following:

Consent to use Dojo Tutoring if your child is under 13:

Dojo Tutor follows the U.S. Federal Trade Commission’s (FTC) Children’s Online Privacy Protection Act and its implementing regulations under the Children’s Online Privacy Protection Rule (collectively “COPPA”) rules for parental consent. COPPA protects the online privacy of children under the age of 13 and requires Dojo Tutor to obtain parental consent or notice (as appropriate) prior (with limited exceptions) to the collection, use, and disclosure of that child's personal information. Dojo Tutor extends the U.S.-based COPPA consent protections in all jurisdictions, even if not required. If we rely on other legally applicable grounds for processing children’s personal information (e.g. if we rely on legitimate interest in the European Union and the United Kingdom), when we act as a controller or if the controller (e.g. school) relies on a certain legally applicable grounds for processing children’s personal information) we will still use the FTC COPPA consent methods described to provide further transparency for parents.  

Due to the requirements of COPPA, Dojo Tutor requires parents (if they are setting up their child’s learner account on Dojo Tutor or otherwise allowing their child access to Dojo Tutor (including to attend a live tutoring session) to give consent before the child can then access the Dojo Tutor Services, attend any live tutoring session, or otherwise use Dojo Tutor (including to upload any content). Once you set up your parent DojoTutor account, your child will then log in through your credentials to utilize the Services (including to attend a live tutoring session) and will not have a traditional username and password login. 

Your child's tutor may wish for your child to join their live online tutoring session.  Dojo Tutor currently uses the Zoom ISV Program to host its tutoring sessions. In addition, Dojo Tutor and Zoom have entered into custom contractual agreements to allow for users under 13 and under which Zoom has also agreed to apply its Education Account Settings to Dojo Tutor’s use of Zoom. This includes treating Dojo Tutor’s use as a Zoom Education Account, applying additional privacy, security and safety features and settings offered to schools to Dojo Tutor’s use of Zoom. The tutoring sessions (including transcripts and Zoom chat logs) are recorded from both learners  (your child) and tutors to provide and maintain the Service (such as to create transcripts of the tutoring sessions, or shorter video “clips” (“Tutoring Highlight Clips”)), conduct internal analysis, and to ensure the safety and quality of tutoring on the Services. These recordings are automatically deleted by Zoom after 14 days and are reviewed by Dojo Tutoring’s safety and quality teams as needed. Separately, within this 14-day period in which Zoom retains these recordings, Dojo Tutor may either download, store and retain these recordings (or elect to have Zoom retain these) for up to an additional 30 days to provide and maintain the Service, conduct internal analysis, and keep our platform safe and secure.  To learn more, read the Zoom Retention Policy. In addition, the Tutoring Highlight Clips will be kept for only so long the Learner Account is active. Please see the Direct Notice provided during your consent for more details on additional information collected and retention periods. 

Dojo Tutoring also has Privacy and Safety settings set on Zoom, including:

  • Passcode-protected tutoring session:  We require a passcode when tutor’s are scheduling new meetings (all meetings need to be accessed with passcodes). When joining the session through the parent’s dashboard, parents would click on the zoom link with the passwords embedded in the URL. 
  • Require Registration:  User registration is required: we automatically pass the learner’s information through our API integration that inputs the learner's name and parents email registered in Dojo Tutoring in the Zoom meeting when accessing the Zoom meeting through our platform. If an external user tries to use the Zoom link to access, they aren’t allowed access. We will see the email address of everyone who signed up to join a tutoring session.  
  • Require passcode for dial-in: If a participant is joining via phone, they must have a passcode. 

Disabled join before host: Learners cannot join the tutoring session before the tutor joins and will see a pop-up that says, “The meeting is waiting for the host to join.“

Consent for certain uses of Student Data outside of school - FERPA & State Student Privacy Laws

Additionally, you may choose to link your ClassDojo Services account with your Dojo Tutor account.  If you sign up for Dojo Tutor using your ClassDojo account, ClassDojo may share and use your ClassDojo Services login credentials (e.g., ClassDojo email address, user name) and your child’s name (and possibly other limited fields of Student Data or personal information of the child that you allows) to pre-populate your Dojo Tutor profile.  Additionally, certain Dojo Tutor tutoring information, such as tutor assessments, feedback, and other session information (e.g. session recordings) (“Dojo Tutor Information”) may be shared at your direction to your child’s teacher to the main ClassDojo Services (“Dojo Tutor Information Sharing”).  When this Dojo Tutor Information Sharing occurs with the ClassDojo Services, a copy of the Dojo Tutor Information will be made to share. This is a copy of the assessment and only this copy will become Student Data once the teacher has elected to save and bring this information into either their account or the student’s Student Account in the main ClassDojo Services. While your child’s personal information (e.g. name) and tutoring information (e.g. tutoring assessments) will be linked and accessible in both your Dojo Tutor and ClassDojo Services accounts, your child’s Student Account information on ClassDojo will remain separate and viewable only through your ClassDojo Services login, ensuring that school information remains segregated and separate from non-school information. We provide this disclosure to obtain your consent through the Direct Notice that is provided in connection with COPPA consent mentioned above.  We have also obtained authorization through our Student Data Privacy Addendum and Terms of Service entered into with schools or districts to allow for this limited use and sharing of Student Data or education records. If your school or district has a custom Student Data Privacy Addendum that limits this sharing, we will also honor this.  

How does a Parent Consent? 

In order for your child to access Dojo Tutor (or otherwise set up your child’s tutoring session), you must first have a parent account on Dojo Tutor through our Dojo Tutor website. You will not be able to join tutoring sessions for your child (and your parent account will have limited functionality) until we receive your consent.

When you visit Dojo Tutor to set up your child for a session, you will be prompted to give your consent at this time (before your child can attend a tutoring session ), shown below.  When you give consent, you are giving your consent for your child to use Dojo Tutor, including to attend live tutoring sessions you set up, access Dojo Tutor through your Dojo Tutor account (or to otherwise access Dojo Tutor), including for Dojo Tutor’s collection, use, and disclosure of your child's personal information as set forth in the disclosure shown to you in the Dojo Tutor mobile application or on the Dojo Tutor website at the time you set up your account- you will not have to leave your account to consent  You will be provided with two check boxes (one for COPPA and one for FERPA & State Student Privacy Laws).  *Please note that you will only be giving consent once when setting up your child’s account (or allowing them access to the Service) and that this consent will also apply to any children that you subsequently allow future access to Dojo Tutor accounts or the Service after your consent.

What you are consenting to

COPPA

You are giving your consent for your child to use a Dojo Tutor learner account, including for Dojo Tutor's collection, use, and disclosure of your child's personal information as set forth in the Direct Notice shown to you within your parent account in the Dojo Tutor mobile application or on the Dojo Tutor website at the time you set up your child’s tutoring session (as demonstrated above). 

Once we have obtained parental consent, your child will be able to participate in the Dojo Tutor tutoring sessions and otherwise use the Dojo Tutor Service.  Although not required under COPPA, we may choose to impose parental consent requirements on learner accounts 13 and above at our discretion.

FERPA & State Student Privacy Laws 

If you check the second check box, you are giving your consent for the limited sharing and use of certain data elements between in school and out of school use (not in connection with a school) or between Dojo Tutor and the main ClassDojo Services product that may be considered Student Data under various state student privacy laws or education records under FERPA. This use and sharing is to enable certain features that you or your child may choose to utilize (including in connection with your child’s Outside School Child Account). What Consent mechanism does Dojo Tutor Use?

When you purchase your child’s tutoring session, we will seek to obtain your parental consent through using a heightened verification method to verify you are the child’s parent. Using your payment method along with your Apple or Google biometrics - such as your fingerprint or FaceID - required by the applicable platform to make the purchase helps to verify and prove your identity.  Note that Dojo Tutor does not collect or have access to either your credit card information or your biometrics.  For a list of what we receive from your payment method, please see here. You will also receive a second email from Dojo Tutor after you have given your consent confirming your consent. We have obtained approval from iKeepSafe to use this method as a heightened method of obtaining verifiable parental consent under COPPA.  

Additionally, even if we offer a “trial” or “free” tutoring session, we will also use the credit card information to verify your identity.

Why do I have to give my Credit Card? 

We’re required by law to obtain verifiable consent from a child’s parent before we gather any personal information from the child. Because of this, we need to verify your identity so we know you are really you. One of the most common, COPPA-approved methods used for verifying identity is to charge or authorize a small amount to a credit card (or alternatively obtain notification of a discrete transaction to the primary account holder without processing a monetary charge). Dojo Tutor currently obtains verifiable parental consent under COPPA through the use of a credit card verification. 

The credit card transaction proves your identity.  Your credit card will NOT be used for any other purpose unless you separately purchase a Dojo Tutoring tutoring session.  

The amount and type of transaction depends on your location:

In the US: For users that are not paying for a tutoring session (e.g. a “free trial), a credit card transaction history will be obtained. This is a temporary authorization hold and not a $ charge to your card. No further charges will be made to your credit card after this transaction history verification  unless you separately purchase a Dojo Tutoring tutoring session.  If you are purchasing a Dojo Tutoring tutoring session(s) at the time you set up your parent account, then the credit card verification will be through the charge you incur for the sessions you purchase.

  • The Privacy Policy describes how Dojo Tutor products and Services collect and use information. As stated in this policy, Dojo Tutor does not use any learner personal information to serve behaviorally-targeted advertising to learners and learner’s personal information is never sold to anyone, including marketers and advertisers.
  • We have also published a separate Children’s Privacy Policy which sets out information about DojoTutor’s processing of personal data in relation to users who are children. It is drafted using clear and plain language, and also includes “bite-sized” summaries of each section in larger font, flagged via a blue information icon.
